9.30.020 Disposition of firearms.
All firearms taken into the custody of the Black Diamond police department on or after July 1, 1993, and that are judicially forfeited or forfeited due to a failure to make a claim under RCW 63.40.010, are to be disposed of as follows:
A.
The Black Diamond police department may retain legal firearms for agency use.
B.
The chief of police, or his or her designee, may auction or trade legal firearms to properly licensed commercial sellers, as deemed appropriate by the chief of police or his or her designee. All proceeds of an auction/trade may be retained by the Black Diamond police department for agency use.
C.
The chief of police or his or her designee may destroy legal firearms in lieu of subsections A and B of this section at the discretion of the chief of police.
D.
Firearms determined by the chief of police or his or her designee to be illegal for any person to possess shall be destroyed.
E.
No firearm shall be disposed of while it is needed for evidence.

9.30.030 Loaded firearm in vehicle—Unlawful use or possession—Penalty.
The city adopts by reference as though fully set forth herein RCW Section 77.15.460 as currently existing or as hereafter amended.
